Which Ukrainians may face deportation from Germany?

Ukrainian refugees residing in Germany are required to adhere to the country's laws; otherwise, they may face deportation, even amidst the ongoing war in Ukraine. This was reported by UNIAN.

In general, the principle of "non-refoulement," which prohibits the expulsion of individuals to countries experiencing armed conflict, applies to Ukrainian refugees. However, it does not extend to those who pose a particular threat or have severely violated German law.

What can lead to deportation?

Ukrainians may be compelled to leave Germany if they:

- illegally crossed the border or attempted to do so;

- are in the country with an expired visa or residence permit;

- submitted forged documents;

- were found guilty of crimes punishable by imprisonment of one year or more;

- are affiliated with terrorist organizations;

- assisted illegal migrants in entering the EU;

- are listed as undesirable persons;

- pose a threat to national security.

Additionally, if a Ukrainian entered Germany legally but did not obtain the required documentation and did not present it to the migration service, this may also serve as grounds for deportation.

How does deportation occur?

Two agencies are responsible for immigration matters in Germany:

- Ausländerbehörde (local foreigners' authority), which most frequently makes deportation decisions;

- BAMF (Federal Office for Migration and Refugees), which handles refugee status issues.

Once a deportation decision is made, the individual receives an official notification specifying the timeframe within which they must voluntarily leave the country. Failure to comply will involve the police and border service. In special cases, the violator may be detained for up to 18 months prior to forced expulsion.

Ukrainians who have been denied refugee status or temporary protection have the right to appeal the decision in court. During the review of their case, they may legally remain in the country.
